A Release of Liability, also known as a liability waiver, is a legal document in which one party agrees not to hold another party responsible for any risks or damages associated with a particular activity or agreement. It’s commonly used in settings like personal training, fitness classes, recreational activities, and other situations where there might be a risk of injury or harm. Here's a general outline for a Release of Liability for Personal Training:
1. Acknowledgment of Risks: The Client acknowledges that participation in personal training activities involves inherent risks, including but not limited to injuries, strains, sprains, or other physical harm. The Client voluntarily assumes all risks associated with participation in the training sessions.
2. Release of Liability: The Client releases, waives, and forever discharges the Trainer, their employees, agents, and representatives from any and all liability, claims, demands, or causes of action arising out of or related to any injury, damage, or loss incurred as a result of participation in training sessions.
3. Health and Fitness Certification: The Client certifies that they are in good health and have consulted with a physician, if necessary, before starting the training program. The Client agrees to disclose any medical conditions, injuries, or limitations that could affect their ability to participate safely.
4. Indemnification: The Client agrees to indemnify and hold harmless the Trainer from any claims or liabilities resulting from injuries or damages sustained during training sessions.
5. Governing Law:This Agreement shall be governed by and construed in accordance with the laws of Georgia, USA.
6. Entire Agreement: This Agreement represents the entire understanding between the Trainer and the Client regarding the subject matter. It supersedes all prior agreements or understandings, whether written or oral.
7. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
